Terms of Service

1. Acceptance of Terms

OSINT.PH is a product of Protectiv IT Security Inc (“Protectiv,” “we,” “us,” or “our”). By creating an account or using the OSINT.PH platform (“Service”), you agree to be bound by these Terms of Service and our Acceptable Use Policy. If you do not agree, you must not use the Service.

2. Eligibility

You must be at least 18 years of age to use the Service. By creating an account, you represent and warrant that you are at least 18 years old and have the legal capacity to enter into this agreement. If you are using the Service on behalf of an organization, you represent that you have authority to bind that organization to these Terms.

3. Service Description

OSINT.PH provides open-source intelligence (OSINT) tools that aggregate publicly available information from third-party sources in real time. Results are compiled from public APIs, websites, and data services at the time of your query. OSINT.PH does not store, cache, or retain any search results or third-party personal data on its servers. All retrieved data is processed in memory during your session and immediately discarded upon delivery. OSINT.PH does not generate, verify, or guarantee the accuracy of any information returned.

4. Data Privacy Disclaimer

OSINT.PH is not a credit information corporation or consumer reporting agency. The Service operates in compliance with Republic Act No. 10173 (Data Privacy Act of 2012) and its Implementing Rules and Regulations.

The Service does not provide consumer credit reports or personal data profiles for decision-making purposes. You may not use the Service, in whole or in part, as a factor in:

  • Determining eligibility for employment, promotion, reassignment, or retention
  • Evaluating an individual for credit, insurance, or other financial decisions
  • Screening tenants or making housing decisions
  • Assessing eligibility for any license, benefit, or government-issued authorization
  • Any purpose that would constitute unauthorized processing of personal information under the Data Privacy Act of 2012

By using the Service, you certify that you will not use any information obtained through OSINT.PH in violation of the Data Privacy Act of 2012 or any related National Privacy Commission issuances.

5. Acceptable Use Policy

You may only use the Service for lawful purposes. Permitted use cases include but are not limited to:

  • Licensed private investigation
  • Corporate security and due diligence
  • Cybersecurity threat intelligence and research
  • Law enforcement and government investigations
  • Journalism and media investigation
  • Academic and security research
  • Personal identity protection and self-lookup
  • Skip tracing and debt recovery (where legally authorized)

Prohibited uses include:

  • Stalking, harassment, intimidation, or threatening any individual
  • Doxxing or publishing private information with intent to harm
  • Discrimination based on race, gender, religion, sexual orientation, or any protected characteristic
  • Employment screening, tenant screening, credit decisions, or any purpose prohibited under the Data Privacy Act of 2012
  • Any activity that violates applicable local, national, or international law
  • Violations of Republic Act No. 10175 (Cybercrime Prevention Act of 2012) or equivalent legislation
  • Circumventing rate limits, scraping, or automated bulk data extraction
  • Reselling, redistributing, or commercially sublicensing search results
  • Using the Service to facilitate identity theft or fraud

6. Activity Logging

All searches are logged in accordance with the Data Privacy Act of 2012. Logs include your user ID, search type, timestamp, and IP address. Logs are retained for compliance, abuse prevention, and to cooperate with law enforcement requests where legally required. OSINT.PH may preserve and disclose account information and search logs when required by law, regulation, court order, or directive from the National Privacy Commission, or when OSINT.PH believes in good faith that such action is necessary to protect the rights, property, or safety of OSINT.PH, its users, or the public.

7. User Responsibility

You are solely responsible for ensuring your use of the Service complies with all applicable laws and regulations in your jurisdiction, including but not limited to the Data Privacy Act of 2012 (RA 10173), the Cybercrime Prevention Act of 2012 (RA 10175), the Anti-Wiretapping Act (RA 4200), and any applicable investigative licensing requirements. OSINT.PH does not provide legal advice.

8. Indemnification

You agree to indemnify, defend, and hold harmless Protectiv IT Security Inc, its owners, operators, officers, employees, and agents from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or related to:

  • Your use of the Service
  • Your violation of these Terms or any applicable law
  • Your violation of any rights of a third party
  • Any claim that your use of the Service caused damage to a third party
  • Any misrepresentation regarding your intended use case

This indemnification obligation survives the termination of your account and these Terms.

9. Account Termination

OSINT.PH reserves the right to suspend or terminate any account that violates these Terms, the Acceptable Use Policy, or is suspected of misuse, without prior notice and without refund. We may also report suspected illegal activity to law enforcement. Upon termination, OSINT.PH may retain search logs and account data as required by law or for legitimate compliance purposes.

10. Intellectual Property

The Service, including its design, code, features, and branding, is the intellectual property of Protectiv IT Security Inc. You are granted a limited, non-exclusive, non-transferable license to use the Service for its intended purpose in accordance with these Terms. You do not acquire any ownership rights in search results, which are compiled from third-party sources. You may not copy, reproduce, reverse engineer, or create derivative works based on any part of the Service.

11. Data Accuracy Disclaimer

Information returned by the Service is aggregated from third-party sources and publicly available data. OSINT.PH makes no warranties regarding the accuracy, completeness, or timeliness of search results. Results may contain errors, outdated information, or data pertaining to different individuals with similar identifiers. You should independently verify any information obtained through the Service before taking action based on it.

12. Limitation of Liability

To the maximum extent permitted by applicable law, the Service is provided “as is” and “as available” without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

In no event shall Protectiv IT Security Inc, its owners, operators, officers, employees, or agents be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, business opportunities, or goodwill, arising out of or in connection with your use of the Service, regardless of the theory of liability.

To the extent OSINT.PH is found liable for any direct damages, such liability shall be limited to the total amount of fees you paid to OSINT.PH in the twelve (12) months preceding the event giving rise to the claim.

13. Dispute Resolution

Any dispute, controversy, or claim arising out of or relating to these Terms or the Service shall be resolved through binding arbitration administered in accordance with Republic Act No. 9285 (Alternative Dispute Resolution Act of 2004). Arbitration shall take place in Quezon City, Philippines and shall be conducted by a single arbitrator.

You agree that any dispute resolution proceedings will be conducted on an individual basis only, and not as a class, consolidated, or representative action.

Notwithstanding the above, either party may seek injunctive or other equitable relief in any court of competent jurisdiction to prevent the actual or threatened infringement or misappropriation of intellectual property rights.

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Republic of the Philippines. To the extent any legal proceeding is permitted outside of arbitration, you consent to the exclusive jurisdiction of the courts of Quezon City, Philippines.

15. Subscriptions and Billing

Paid subscriptions are billed through Polar.sh, our Merchant of Record. Credits do not roll over between billing periods. Refunds are not provided for unused credits or mid-cycle cancellations. OSINT.PH reserves the right to modify pricing with 30 days notice.

16. Modifications

OSINT.PH may update these Terms at any time. When we do, we will update the “Last updated” date and increment the version number. Continued use of the Service after changes constitutes acceptance. If the Terms change materially, you will be required to re-accept them.
